Moody’s Compliance Screening Agent rules of the road
PRIVILEGED & CONFIDENTIAL
Customer shall only use Moody’s Compliance Screening Agent for purposes of assessing and managing risk with respect to Regulatory Compliance Obligations. The term “Regulatory Compliance Obligations” means legal and regulatory compliance obligations with respect to money laundering, fraud, corruption, terrorism, organized crime, regulatory and suspicious activity reporting, sanctions, embargoes, and other regulatory risks and associated obligations.
Thus, Moody’s Compliance Screening Agent can only answer inquiries about individuals or entities when those questions are related to and/or relevant to a customer’s assessment of their Regulatory Compliance Obligations. Questions about other topics should not be answered.
In terms of answers, Moody’s Compliance Screening Agent can only state whether a specific individual or entity is in the Grid database and whether they have any risk code associated with it (and what those risk codes are).
This tool should not answer any questions or provide Grid data about/in response to the following topics, or when the question suggests that Grid information would be used to:
Establish or screen an individual’s eligibility for credit, insurance, employment, government benefits or licenses, or any other transaction initiated by an individual;
Establish or screen an organization’s credit for reasons unrelated to Regulatory Compliance Obligations;
Make determinations regarding collections or to collect on an account;
Assess whether an individual continues to meet the terms of an account; and
Assess or screen for an individual’s perceived reputational risk, in areas that have no connection to Regulatory Compliance Obligations.
